APABA Silicon Valley’s IP Committee, in collaboration with NEDO, invites you to an insightful seminar on the evolving global landscape of Standard Essential Patents (SEPs).

As courts and regulators across key jurisdictions revisit fundamental questions around SEP enforcement, this program will explore how FRAND obligations are being applied in practice, how “willingness” to license is evaluated, and when injunctive relief may be available. These developments are actively reshaping negotiation dynamics and litigation strategies worldwide.

Japan has recently emerged as a significant forum for SEP disputes, including issuing its first-ever injunction based on an implementer’s “unwillingness” to participate in court-led settlement. Meanwhile, the United States continues to influence SEP policy through evolving case law and renewed attention on remedies available to SEP owners.
