APABA Silicon Valley is proud to join the Japanese American Citizens League (JACL) and more than 60 Asian American and Pacific Islander (AAPI) organizations in filing an amicus curiae brief with the United States Court of Appeals for the Fifth Circuit on June 2, 2025. The brief urges the Court to fulfill its constitutional role as a check on executive overreach in cases involving the federal government’s invocation of the Alien Enemies Act and to safeguard the due process rights guaranteed under the U.S. Constitution.
Prepared by pro bono counsel from leading civil rights organizations, the amicus brief highlights the troubling history of the Alien Enemies Act, which was used during World War II to detain and incarcerate Japanese Americans without trial. The amici warn against repeating these grave injustices and emphasize the need for meaningful judicial scrutiny to prevent discrimination and to uphold the Constitution’s promises of equal protection and fairness under the law.
