In recent years, prosecutors have grown determined in their efforts to include the conduct of general counsel in furtherance of their lawyerly roles within the scope of white collar investigations and prosecutions targeting companies. Of particular concern is that the criminal theory advanced in these matters increasingly is being based on prosecutors’ portrayal of counsel’s conduct as a mere failure of duty or care, thereby unfairly converting professional conduct standards into criminal ones.

Please join APABA’s In-House Counsel Committee for a lunchtime CLE discussion of these issues with Gibson Dunn partner and former federal prosecutor Winston Chan, and associate Grace Tsou. Both recently completed the 3-month trial and defense of United States v. Evan Greebel in the Eastern District of New York, a federal securities and wire fraud prosecution of the corporate counsel to a pharmaceutical company founded by Martin Shkreli (a.k.a. “Pharmabro”).
