In recent years, prosecutors have grown determined in their efforts to include the conduct of general counsel in furtherance of their lawyerly roles within the scope of white collar investigations and prosecutions targeting companies. Of particular concern is that the criminal theory advanced in these matters increasingly is being based on prosecutors’ portrayal of counsel’s conduct as a mere failure of duty or care, thereby unfairly converting professional conduct standards into criminal ones.

Both recently completed the 3-month trial and defense of United States v. Evan Greebel in the Eastern District of New York, a federal securities and wire fraud prosecution of the corporate counsel to a pharmaceutical company founded by Martin Shkreli (a.k.a. “Pharmabro”).
