In the almost two years of contested proceedings under the AIA, over 1,500 IPR petitions and over 200 CBM petitions have been filed. The PTAB has now issued hundreds of institution decisions and numerous final decisions on the merits, revealing valuable lessons for both petitioners and patent owners. Please join our panelists for an open discussion on best practices, interplay with ongoing litigation, and strategies to consider. They plan to address recent decisions relating to who should be named as a real party-in-interest, why so many petitions are being bounced, and how to make sure the PTAB adopts and maintains grounds in petitions.
